Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the WordPlus application, Telegram bot, and website (collectively, the "Services") provided by IE Volodymyr Voitsekhivskyi ("Company", "we", "us"). By using the Services, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Services. By creating an account, you confirm that you are 16 or older. We verify your age at registration. If we discover that a user is under 16, their account and all associated data will be deleted.

2. User Accounts

2.1. You may register using your email address, Google account, Apple account, or phone number. Registration is free.

2.2. You are responsible for maintaining the security of your account credentials. You must not share your account with others.

2.3. You may connect your account to our Telegram Bot for additional learning features. The Bot is an integral part of the Services.

3. Description of Services

WordPlus is an interactive language-learning platform that includes:

• A mobile application for iOS and Android with vocabulary training, spaced repetition, and AI-powered exercises
• A Telegram bot for conversational learning, translation, quizzes, and voice practice
• A website with information about the Services
• A Market where users can share and discover learning sets

4. AI-Powered Features

4.1. The Services use artificial intelligence to generate learning content, exercises, translations, and conversational responses. AI-generated content is provided "as is" — we do not guarantee its accuracy, completeness, or suitability for any specific purpose.

4.2. You must not rely on AI-generated content for professional, medical, legal, or financial decisions.

4.3. AI features must be used in accordance with our Acceptable Use Policy (Section 5). You must not attempt to manipulate AI systems to produce harmful, illegal, or offensive content.

5. Acceptable Use Policy

You agree not to:

• Use the Services for any illegal purpose or in violation of any applicable law
• Attempt to gain unauthorized access to our systems, other user accounts, or data
• Use automated tools, bots, or scrapers to access the Services (except our official Telegram Bot)
• Upload or distribute malware, viruses, or harmful code
• Harass, abuse, or harm other users
• Publish offensive, defamatory, or illegal content on the Market
• Circumvent any security, rate-limiting, or access-control features
• Resell, redistribute, or commercially exploit the Services without our written permission

6. Intellectual Property

6.1. All content, design, software, trademarks, and materials within the Services are the intellectual property of the Company or its licensors and are protected by applicable copyright and intellectual property laws.

6.2. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial, educational purposes only.

6.3. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Services without our prior written consent.

7. User-Generated Content and Market

7.1. You retain ownership of any learning sets, cards, and other content you create ("User Content").

7.2. By publishing User Content on the Market, you grant the Company a non-exclusive, worldwide, royalty-free license to display, distribute, and make available your User Content within the Services.

7.3. User Content must not contain offensive, illegal, infringing, or harmful material. We reserve the right to remove any User Content that violates these Terms.

7.4. You are solely responsible for the User Content you publish and any consequences of sharing it.

8. Virtual Currency (Diamonds)

8.1. The Services may include a virtual currency ("Diamonds") that can be earned or purchased and used within the App.

8.2. Diamonds have no real-world monetary value and cannot be exchanged for cash or any other form of value outside the Services.

8.3. Diamonds are non-refundable except where required by applicable law.

8.4. We reserve the right to modify the Diamond economy, including prices, earning rates, and available items, at any time.

9. Subscriptions and Purchases

9.1. Premium features are available through subscription plans managed by the Apple App Store and Google Play Store.

9.2. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. Cancellation deadlines and procedures are determined by the respective platform (Apple App Store or Google Play Store).

9.3. To cancel a subscription, use the subscription management settings in your Apple App Store or Google Play Store account.

9.4. Refunds are handled by the respective platform (Apple or Google) in accordance with their refund policies.

10. Account Termination and Deletion

10.1. By you: You may delete your account at any time using the "Delete Account" button in the App settings or by requesting data deletion through the Telegram Bot. Deletion permanently removes all your data from our active systems.

10.2. By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Services. We will notify you of the reason unless prohibited by law.

10.3. Inactive accounts: Accounts that have been inactive for 2 years are automatically deleted after a 30-day warning period. See our Privacy Policy for details.

11. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, data, or business opportunity, arising out of or related to your use of the Services. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be struck and the remaining provisions shall remain in full force and effect.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power or internet outages, or failures of third-party infrastructure or services.

15. Dispute Resolution

15.1. Any dispute arising from these Terms shall first be resolved through good-faith negotiation. You may contact us at support@wordplus.app.

15.2. If negotiation fails, disputes shall be resolved in accordance with Ukrainian law and submitted to the courts of Ukraine. This choice of law does not deprive you of any mandatory consumer protection provisions of the country in which you reside.

15.3. If you are a consumer in the European Union, you may also refer a dispute to the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration body.

16. Changes to These Terms

We may update these Terms from time to time. For significant changes, we will notify you via the App or email at least 30 days before the changes take effect. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes.
